Retail theft is a serious crime, and depending on the value of the items stolen, can result in a hefty prison sentence. Shoplifting is divided as petit theft or retail theft depending on the value of the items that were stolen. Normally, when an item stolen is $100 or less the charge will be filed as a second degree misdemeanor in the state of Florida. When goods are between $100 and $300 this is filed typically filed as a first-degree misdemeanor.
If you have been arrested for retail theft, you can use a variety of different defenses. You can argue that you were framed, and that the items were placed in your bag by another or you can argue that you unintentionally took the items out of the store. Also, you can argue that you paid for the item if you believe that the cashier just failed to take the sensor off.
