On Friday, January, 30, 2015, a pregnant woman was sentenced to 15 years in prison after she got drunk one Sunday afternoon in 2012, and drove her vehicle into a poolside cabana at the Riverside Hotel in Fort Lauderdale, where she killed a pregnant woman.
Rosa K., 37, pleaded guilty to two counts of DUI manslaughter after causing the deaths of Alanna D., 26, and her unborn son on March 18, 2012. When the defendant was arrested, she had a blood alcohol content (BAC) of 0.24%, three times above the legal limit.
At the time of the incident, the victim was seven months pregnant with her first child. The victim and her husband were visiting Fort Lauderdale after winning a trip from their local church in Woburn, Mass. The trip was to a two-day marriage conference.
The victim's husband was in the restroom just a few short feet away when Rosa's vehicle jumped a curb and plowed directly into the couple's cabana.
Results of the Sentencing Hearing
The defendant is a mother of three, who is became pregnant with her fourth child five months ago. It was an emotional testimony from both the defendant and the victim's family.
The victim was a schoolteacher who deliberately abstained from alcohol and longed to be a mother. In fact, she was active in her high school's chapter of Students Against Drunk Driving.
"All I can say is I'm so sorry," Rosa said through tears. "If I could do anything to bring them back, I would…I would have thrown myself in front of a car if I would have seen that happening."
The Assistant State Attorney, Michael Horowitz called the defendant's pregnancy "appalling and manipulative." He asked the judge to impose a 20-year sentence, while the defense attorney requested a 4-year sentence – the minimum allowed under the law.
Judge Bober imposed a 15-year sentence, along with 15 years of probation. Each year Rosa is on probation, she will have to serve 50 years of community service. She will never drive again, as her driver's license has been revoked permanently.
The defendant will be taken to a hospital to deliver her baby via C-Section at the end of May. Her family will be raising the child while she serves her prison sentence.
