The Breath Test
A person who is arrested for driving under the influence (DUI) in Tampa, Florida will be asked to submit to a chemical test, most often a breath test, to determine his or her blood alcohol concentration (BAC). Also referred to as a breathalyzer test, the breath test is administered using a device called the Intoxilyzer 8000. This machine measures the concentration of alcohol deep within the driver's lungs and uses a formula to then determine the amount of alcohol in the driver's blood. It is important to remember that this is not a precise formula - there is no way to determine with complete accuracy the driver's blood alcohol concentration by taking a breath sample. The possibility of skewed test results is increased even further in the presence of an improperly administered test.
If you took a breath test after an arrest for drunk driving and had a result of .08% or greater, this does not mean that you should or will be convicted of DUI. Let a Tampa DUI lawyer at Thomas & Paulk help you fight your charges to avoid a conviction and the serious consequences that this may have on you now and into the future. With our experience in criminal defense representation and our commitment to our clients, we are confident in our ability to help you challenge your charges and work toward a brighter future.
There are different ways in which a breath test can be questioned. For example:
- Was the test administered correctly?
- Did you burp, vomit, smoke or drink in the 15 minutes prior to the administration of the test?
- Did a trained professional administer your breath test?
- Was the Intoxilyzer properly calibrated and maintained in accordance with state standards?
- Do you have dentures or recent dental work that would have contributed to the presence of "mouth alcohol"?
- Were you on a special diet that would have led to a high result on a breath test?
- Did something else interfere with the test?
