Bay Pines Man Critically Injures 2 on Harley

PINELLAS PARK, Fla. – On Sunday (Dec. 6) a man turned left in front of a motorcycle, critically injuring the rider and his female passenger. The man who failed to yield the right of way is now facing DUI charges, according to troopers.

Around 6 p.m., R. Mullen, 65, of Bay Pines was driving his Ford F150 northbound on Belcher Road, when he attempted to turn left onto 90th Ave. N., according to the Florida Highway Patrol.

As Mullen tried to turn left before oncoming traffic, he turned in front of an oncoming 2007 Harley Davidson motorcycle, which was driven by K. John Jones, 51, of St. Petersburg, said troopers.

After the Ford collided with the Harley, Jones and his female passenger, D. Lee Harms, 47, were seriously injured in the crash and transported to Bayfront Health St. Petersburg where they were both listed in critical condition, troopers said.

Mullen was arrested and subsequently charged with possession of cannabis, violation of right-of-way, and DUI with serious bodily injury, according to the Tampa Tribune.

Penalties for DUI With Serious Bodily Injury in Florida

Mullen is facing serious penalties for the crash that occurred over the weekend. For example, under Florida law, anyone who commits DUI with serious bodily injury to another person commits a felony of the third degree, punishable by:

  • Up to 5 years in prison
  • A fine not to exceed $5,000

Violating the right-of-way in Florida is a noncriminal infraction, and thereby punished as a moving violation under chapter 318.

While we don’t know how much cannabis (marijuana) Mullen had on him at the time of arrest, we do know that possessing 20 grams or less is a misdemeanor in Florida, punishable by up to 1 year in jail and a maximum fine of $1,000.

Possession of more than 20 grams to 25 pounds of marijuana is a felony, punishable by up to 5 years and up to a $5,000 fine.
