Child Abuse Under Florida Law

Child abuse is covered under Section 827.03 of the Florida Statutes. In Florida, child abuse is prosecuted as a felony offense, therefore, a conviction of this nature can have life-altering consequences for the accused.

Child abuse offenses under §827.03 include:

  • Aggravated child abuse – felony of the first degree
  • Child abuse causing great bodily harm – felony of the second degree
  • Willfully abusing a child without causing great bodily harm – felony of the third degree
  • Child neglect without great bodily harm – felony of the third degree

As a first degree felony, child abuse is punishable by up to 30 years in prison and a $10,000 fine.

Child abuse as a second degree felony is punishable by up to 15 years in prison and a $10,000 fine.

If prosecuted as a third degree felony, child abuse is punishable by up to 5 years in prison and a $5,000 fine.
